BACKGROUND
International Development Law Organization (IDLO) is the only intergovernmental organization exclusively devoted to promoting the rule of law. IDLO works to enable governments and empower people to reform laws and strengthen institutions to promote peace, justice, sustainable development, and economic opportunity. Currently, IDLO is providing technical support to the Office of the Attorney General and Department of Justice, the Kenya Law Reform Commission, the Judiciary, the Ministry of Devolution and Planning (MoDP), the Council of Governors, the Kenya National Commission on Human Rights (KNCHR), the National Gender and Equality Commission(NGEC), the State Department of Gender and the Ministry of Mining in implementing the Constitution of Kenya 2010 by way of strategic policy development, critical legislative review, expert technical advice, institutional strengthening, and capacity building.
The Public Procurement Administrative Review Board (PPARB) is established under Section 27 (1) of the Public Procurement and Asset Disposal Act, 2015. The Review Board was established to promote and uphold fairness in the Public Procurement System through judicious, expeditious, and impartial adjudication of matters arising from disputed procurement proceedings in order to promote transparency, accountability, and public confidence.
THE ASSIGNMENT
The Public Procurement Administrative Review Board (PPARB)in partnership with IDLO, seeks to engage a Consultant to develop a Case Direst of the Public Procurement Administrative Review Board (PPARB) Decisions for the period 2014 – 2020. The Case Digest will serve as a reference tool for PPARB to inform their decisions and enhance the consistency of judgments. The Case Digest will also serve as a reference tool for candidates and tenderers in a procurement process as well as procuring entities who may be parties in the Public Procurement Administrative Review process.
The Consultant’s duties and responsibilities will include:
- Carry out an inception meeting with the PPARB Chairperson and team, to un-park the TORs and discuss the scope of the assignment, methodology, and expectations.
- Carry out desk research of the scope and nature of cases handled, and rulings/judgments delivered by PPARB in the period 2014 – 2020.
- Do a comparative analysis of similar case digests within and from other jurisdictions, focusing on organization, format, scope, analysis of the decisions, and conclusions from the analysis.
- Develop a Draft Case Digest of PPARB decisions and present the draft during internal and external stakeholders’ consultative meetings, in consultation with PPARB and IDLO.
- Incorporate the feedback draft from the stakeholders’ consultative meetings and develop the final draft of the Digest.
- Conduct a validation workshop with PPARB Members and Stakeholders for the final draft Case Digest.
- Finalize and present the Case Digest in law report format in readiness for publication.
DELIVERABLES
The Consultant will deliver the following:
- An Inception Report detailing the approach/methodology, clear milestones and timelines, detailed work plan, potential risks, and mitigation measures.
- A compilation of the desk research and comparative analysis materials that informed the development of the Case Digest.
- First Draft of the Case Digest of PPARB decisions.
- Final Draft Case Digest of PPARB Decisions presented in a designed and publication format.
- Final comprehensive reports detailing the accomplished work, achievements, processes, challenges, and lessons learned.
DURATION OF THE ASSIGNMENT
The consultancy contracts will run for three (3) months from 1st August 2021 to 31st October 2021. The assignment is output based and flexibility of scheduling and availability might be required to ensure completion of work during the time frame.
IDEAL CANDIDATE PROFILE
Education
- Bachelor’s Degree in Law from a University recognized in Kenya.
- Post Graduate Diploma from Kenya School of Law.
- A Master’s Degree in a relevant field from a University recognized in Kenya will be an added advantage.
Work experience
- An advocate of the High Court with at least ten (10) years post-admission experience.
- Minimum of 7-10 years professional experience in legal research, analysis, drafting and law reporting.
- Experience in public procurement policy, legal and institutional reforms will be an added advantage.
- Demonstrated understanding of the social, political and economic context in Kenya including sound knowledge of public procurement dispute resolution.
- At least one publication in law reporting.
Technical competencies
- Excellent organizational, interpersonal, and communication skills.
- Excellent work ethic founded on the principles of integrity, impartiality, and confidentiality.
- Professionalism in the process of engaging with IDLO and the Public Procurement Administrative Review Board Members and staff.
- Proficiency with Microsoft Office programs and other relevant computer applications.
TIMELINES
The assignment will be undertaken for a short-term period of three (3)months, on an output basis. The consultancy fee is subject to a 5% KRA withholding tax.
REPORTING AND SUPERVISIONÂ
The consultant shall report directly to the Chairperson of the Public Procurement Administrative Review Board and the Field Programme Manager for the Access to Justice at IDLO, Kenya respectively.
