Contract Duration:           For initial appointments, the Court offers a two-year appointment with the possibility of extension (six month probationary period).

A roster of suitable candidates may be established for this post as a result of this selection process for fixed-term appointments against both established posts and positions funded by general temporary assistance (GTA).

Organisational Context

The Presidency is entrusted with three main functions: administrative, external relations, and judicial/legal. The Presidency Legal and Enforcement Unit performs a range of judicial and legal functions in support of the Presidency’s responsibility for the proper administration of the Court. The Presidency provides support to enable the Chambers to conduct fair, effective and expeditious public proceedings such as constituting and assigning situations to Chambers, organizing the plenary sessions and liaising with the Registry. In addition, the Presidency has specific legal and judicial functions, including the judicial review of certain decisions of the Registrar; the conclusion and implementation of Court wide cooperation agreements (e.g. Bilateral arrangements with States on the enforcement of sentences); and the provision of general legal advice.

Duties and Responsibilities

Within delegated authority, and under the overall supervision of the Chef de Cabinet, the incumbent will be responsible for the duties described below:

1) To oversee the provision of solution-oriented legal (procedural and substantive) and policy (strategic and operational) advice to the Presidency and the Chef de Cabinet in accordance with the mandate of the Unit as described above, including on administrative law, international institutional law, human rights and public international law and other relevant areas of law;

2) More in particular

(a) to organize and supervise legal research on highly complex judicial and legal issues, prepare legal opinions, studies, policies, briefs, reports and correspondences, review legal instruments, and ensure the implementation of legal policy;

(b) to oversee the development and maintenance of legal databases and charts in relation to the fields listed above;

(c) to represent the Presidency and the Court in negotiations on Court-wide cooperation agreements, specifically with respect to the enforcement of sentences (including the  supervision of sentences of imprisonment and the enforcement of fines, forfeitures and reparation orders) and general international cooperation, including supporting the negotiation and draft of voluntary cooperation agreements.

3) To represent the Presidency and the Chef de Cabinet at high level meetings, both inter-organ and beyond (such as the Assembly of States Parties’ facilitations and working groups), as required;

4) To serve on standing boards, committees, working groups, and task forces, as required;

5) To manage the Unit, supervise the staff, organize and prioritize the workload, and to provide supervision and coordination of assignments; and

6) To perform any other assignments, as required.

Essential Qualifications

Education:

An advanced university degree in law, with emphasis on international criminal law, public international law, international humanitarian law, international human rights law, and administrative law or other relevant focus, is required.

A first level university degree in combination with two additional years of qualifying experience is accepted in lieu of the advanced university degree.

Experience:

A minimum of seven (7) years (9 years with a first level university degree) of relevant and progressively responsible professional experience in the legal field, preferably at the international level.

Prior experience in preparing or conducting complex legal cases would be considered a strong asset.

Knowledge, Skills and Abilities:

– Fully proficient computer skills and ability to use relevant software applications, in particular information databases, internet /intranet services, library sources, etc.

– Excellent research and drafting skills;

– In-depth knowledge of the ICC legal framework;

– Ability to understand complex legal concepts, to apply the law to the facts;

– Good analytical skills and ability to identify problems;

– Excellent interpersonal skills and written, spoken and presentational communication skills;

– Demonstrated intellectual leadership and managerial skills;

– Ability to make quality decisions under extreme time constraints;

– Ability to establish and maintain effective working relations with colleagues of different national and cultural backgrounds with appreciation of diversity;

Knowledge of Languages:

Proficiency in one of the working languages of the Court, English or French and working knowledge of the other is required. Knowledge of another official language of the Court (Arabic, Chinese, Russian or Spanish) would be considered an asset.

Nationals from the list of non-represented and under-represented States are strongly encouraged to apply.
